In one such incident, CJI SA Bobde on Monday asked a government employee, accused of repeatedly raping a young woman when she was 16, if he'd marry her.
In another incident, The Supreme Court stayed the arrest of a man accused of rape by his former live-in partner. The woman had alleged the man had promised to marry her and had been "brutally abusive". To which, the SC asked, "When two people are living as husband and wife...however brutal the husband is, can sexual intercourse between them be called rape?"
